What to Expect During Mediation

Mediation is designed to be structured, respectful, and focused on solutions. Each session is guided by the mediator and proceeds at a pace that allows both parties to be heard.

In most mediations, the process generally includes:
• an initial overview of the process and ground rules
• identification of the issues that need to be resolved
• discussion of options and possible solutions
• private sessions with each party when helpful
• negotiation toward workable agreements


Some mediations are completed in a single session, while others may require additional meetings depending on the complexity of the issues involved.

If agreements are reached, the terms are typically summarized in writing so they may be reviewed by the parties and, when appropriate, incorporated into a court order.


Preparing for Mediation

Mediation tends to be most productive when parties arrive prepared and willing to engage in constructive conversation.

Before mediation, parties may be asked to gather relevant information such as:
• financial documents and property information
• proposed parenting schedules
• child-related expenses
• any existing court orders or agreements


It is also helpful for each party to think about their priorities and areas where compromise may be possible.

The goal of mediation is not to “win,” but to reach agreements that allow families to move forward with clarity and stability.



When Mediation May Not Be Appropriate

While mediation can be very effective in many situations, there are circumstances where it may not be the right process.

Mediation may not be appropriate in cases involving:
• ongoing domestic violence or intimidation
• situations where one party cannot participate safely or freely
• certain emergency matters requiring immediate court intervention


Each situation is unique. If mediation is not appropriate, the parties and their attorneys may still explore other legal options through the court system.

How Mediation Works

Step One: Initial Consultation
We discuss your situation, goals, and whether mediation is the right fit. If all parties are willing to negotiate in good faith, we move forward.

Step Two: Mediation Sessions
In confidential sessions (in-person or virtual), we work through each issue. The number of sessions depends on the complexity of your matter.

Step Three: Resolution
If terms are agreed upon, parties leave with a clear path forward.
